TERMS OF USE

1. PURPOSE OF THE APPLICATION

ShopMahelso is a commercial management and inventory application that notably allows:

• management of products, stock and variants,
• creation and management of shops,
• tracking of sales and takings,
• management of employees and their permissions,
• generation of reports and statistics,
• access to Premium features via subscription (Google Play or FedaPay).

2. ACCESS TO THE APPLICATION

Using ShopMahelso requires:

• creation of an account,
• an internet connection,
• a compatible Android device,
• a recommended minimum version of the operating system.

The user is responsible for:

• their equipment,
• their internet connection,
• keeping their login credentials confidential.

3. ACCOUNT CREATION

To use ShopMahelso, the user must provide:

• a valid email address,
• a secure password.

The information provided must be accurate, complete and kept up to date.

4. USE OF THE APPLICATION

The user agrees not to:

• use the application for fraudulent, illegal or unauthorized purposes,
• modify, copy, reverse engineer or bypass security mechanisms,
• share their account with any third party,
• infringe ShopMahelso’s intellectual property rights,
• disrupt the functioning of the app or attempt to access it via unauthorized means.

5. PREMIUM SERVICES & SUBSCRIPTIONS

Certain features are only available with a Premium subscription.

5.1. Payment via Google Play (Android)

• Subscriptions are managed by Google Play Billing.
• Prices are shown at the time of purchase.
• Billing and renewal are entirely managed by Google.
• Cancellation must be performed from the user’s Google account.

5.2. Payment via FedaPay

Available in certain countries (Benin, Togo, Senegal, Niger, Mali, Côte d’Ivoire).

• Payment can be made via Mobile Money or local card.
• Automatic confirmation activates the subscription inside ShopMahelso.
• The subscription must be renewed manually at the end of each period.

5.3. Activation & suspension

• The subscription is activated once payment is confirmed.
• Failure to renew will suspend access to Premium features.

5.4. Refunds

Payments made via Google Play or FedaPay are non-refundable, except where required by applicable law.

6. SHOP & DATA MANAGEMENT

The user can:

• create several shops,
• add products,
• manage employees and their permissions.

The user is solely responsible for the data they enter:

• text, images, prices, stock levels, sales, and so on.

ShopMahelso cannot be held liable for input errors or poor management on the part of the user.

7. LIABILITY

7.1. User’s liability

The user is responsible for:

• the accuracy of the data submitted,
• all operations carried out in their account or shop,
• the security of their device.

7.2. Publisher’s liability (MAHUGNON SERVICES LTD)

We undertake to:

• ensure continuous access to the app (excluding maintenance),
• protect data using appropriate security measures,
• fix identified bugs.

However, we do not guarantee:

• the complete absence of errors,
• uninterrupted operation,
• compatibility with all devices.

8. CHANGES TO THE APP & TO THE TERMS

We may:

• add or remove features,
• change access conditions,
• update these Terms of Use.

The user will be informed of any significant changes by notification or message within the app.

9. INTELLECTUAL PROPERTY

ShopMahelso, its logo, design, features and source code are the exclusive property of:

MAHUGNON SERVICES LTD

Any reproduction, distribution, modification or copy without prior authorization is prohibited.

10. PERSONAL DATA (GDPR)

Data processing carried out by ShopMahelso is described in our Privacy Policy.

In accordance with the GDPR, the user has rights of access, rectification, erasure, objection and portability, which can be exercised by contacting: support@shopmahelso.com

11. SECURITY

We implement in particular:

• encrypted communications (HTTPS),
• access control and row-level security (Supabase RLS),
• secure data storage,
• API keys protected on the server side.

The user must:

• use a secure device,
• keep their password confidential.

12. SUSPENSION OR CLOSURE OF ACCOUNT

We may suspend or delete an account in the event of:

• serious breach of these Terms,
• fraud,
• illegal activities,
• legal or judicial request.

The user may request deletion of their account by email.

13. LIMITATION OF LIABILITY

MAHUGNON SERVICES LTD cannot be held liable for:

• financial losses resulting from incorrect use of the app,
• inventory errors attributable to the user,
• interruptions or bugs related to the internet or hardware,
• loss of data caused by misuse of the application.

14. APPLICABLE LAW & JURISDICTION

These Terms of Use are governed by:

• English law (United Kingdom),
• and, where applicable, the local laws of the user (including the GDPR in Europe).

In case of dispute, the competent courts will be those of the United Kingdom, subject to any mandatory provisions applicable in the user’s country.
